Welcome to BadtameezClub. This website (badtameezclub.in) is owned and operated by BadtameezClub ("we," "us," or "our"). Throughout the site, the terms "we", "us", and "our" refer to BadtameezClub. By accessing our website, browsing our catalog, or purchasing an item, you engage in our "Service" and agree to be bound by the following Terms of Service ("Terms").

Please read these Terms carefully before accessing or using our website. If you do not agree to all the terms and conditions of this agreement, you may not access the website or use any Services.

1. General Conditions & Eligibility

By agreeing to these Terms of Service, you represent that you are at least the age of majority in your state or province of residence, or that you have given us your consent to allow any of your minor dependents to use this site.

You may not use our products for any illegal or unauthorized purpose, nor may you violate any laws in your jurisdiction (including but not limited to copyright and trademark laws). A breach or violation of any of the Terms will result in an immediate termination of your Services and potential legal recourse.

2. Made-to-Order Products & Visual Tolerances

All apparel sold on BadtameezClub is manufactured on demand. By placing an order, you acknowledge and agree to the following physical tolerances:

Color & Screen Variations: We make every effort to display the colors and details of our graphics and fabrics as accurately as possible. However, because monitor calibrations, phone screen profiles, and textile ink absorptions vary, the exact physical print tones may exhibit subtle variations from the digital preview on your screen.
Sizing Tolerances: All garments are subject to an industry-standard manufacturing tolerance of up to +/- 0.5 to 1 inch in chest width or body length compared to our published Size Guide.
Design Placement: Print positioning (Direct-to-Film transfers) may vary slightly in placement depending on the specific blank size ordered (e.g., a print on an S blank will occupy a different visual proportion than on an XXL blank).

3. Pricing, Billing & Payment Processing

Pricing: All prices on the website are listed in Indian Rupees (INR) and are inclusive of applicable taxes unless stated otherwise. We reserve the right to modify prices, discontinue products, or adjust shipping rates at any time without prior notice.
Prepaid Transactions: Online payments (UPI, Credit/Debit Cards, Net Banking) are securely routed and processed through authorized third-party payment aggregators (such as Razorpay). We do not store or capture your raw banking passwords, card numbers, or UPI PINs.
Cash on Delivery (COD): If COD is selected, you agree to inspect the order confirmation, pay the total invoice amount in full to the courier personnel upon delivery, and remain available at the delivery location. We reserve the right to cancel or blacklist accounts with repeated unverified or refused COD attempts.

4. Order Acceptance & Right to Refuse

The receipt of an order number or email confirmation does not constitute our legal acceptance of an order or an offer to sell. We reserve the right, at our sole discretion, to refuse or cancel any order for reasons including, but not limited to:

Suspected fraudulent, unauthorized, or bad-faith transactions.
Unreachable customer contact details or unserviceable pin codes.
Pricing or typographical errors in product listings.
Unavailability of garment blanks or fabric stock at our production hubs.

If an order is cancelled after your payment has already been debited, a full refund will be initiated back to your original source account within standard banking settlement timelines (5–7 business days).

5. Shipping, Courier Delays & Risk of Loss

Dispatch: Orders typically undergo 2 to 3 business days of production before dispatch, followed by estimated transit times of 3 to 5 business days depending on destination logistics.
Third-Party Logistics: Shipping is handled via third-party courier partners (e.g., Delhivery, Blue Dart, Xpressbees). BadtameezClub shall not be held liable for courier transit delays caused by extreme weather, regional lockdowns, festive transit backlogs, strikes, or incorrect address information provided by the customer.
Failed Deliveries (RTO): If a shipment is returned to origin due to incorrect customer details, an incomplete address, or failure to accept delivery after multiple courier attempts, the customer shall be responsible for re-shipping charges.

6. Intellectual Property Rights

All content on this website—including but not limited to brand names, logos, mascot illustrations, custom typography, apparel graphics, product mockups, copy, and layout code—is the exclusive intellectual property of BadtameezClub. You may not reproduce, duplicate, copy, sell, resell, distribute, or exploit any portion of our artwork, designs, or branding without express written permission from us.

7. Limitation of Liability

In no event shall BadtameezClub, our directors, officers, employees, affiliates, suppliers, or logistics partners be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind arising from your use of any of the Service or any products procured using the Service.

To the maximum extent permitted by applicable Indian law, our total aggregate liability for any claim arising out of or relating to your purchase of any product shall be limited strictly to the purchase price paid by you for that specific item.

8. Governing Law & Dispute Jurisdiction

These Terms of Service and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of the Republic of India. Any disputes, claims, or controversies arising out of or in connection with these Terms or your use of the website shall be subject to the exclusive jurisdiction of the competent courts in India.

9. Changes to Terms of Service

We reserve the right, at our sole discretion, to update, change, or replace any part of these Terms of Service by posting updates and changes to our website. It is your responsibility to check our website periodically for changes. Your continued use of or access to our website or the Service following the posting of any changes constitutes acceptance of those changes.
